Terms and Conditions of Service

Jettison Environmental LLC

These Terms and Conditions govern the rental and servicing of portable sanitation equipment provided by Jettison Environmental LLC (“Company”). By ordering services, accepting delivery, or making payment, the Customer agrees to all terms outlined below.

1. Equipment Ownership

All portable toilets, handwashing stations, holding tanks, and related sanitation equipment (“Equipment”) remain the exclusive property of Jettison Environmental LLC.

Customer receives temporary use only for the rental period.

2. Rental Period

The rental period begins on the date of delivery and continues until the Equipment is retrieved by the Company.

Construction Site Minimum Rental

For construction or long-term job sites, a minimum rental period of twenty-eight (28) days applies. Early pickup does not waive this minimum rental charge.

Rental periods may automatically renew on a weekly or monthly basis unless otherwise terminated.

3. Delivery and Placement

Customer agrees to provide:

  • Safe and level ground for placement
  • Clear truck access for delivery, service, and pickup
  • Minimum 10 feet of clearance for service vehicles

The Company may refuse delivery if site conditions are unsafe or inaccessible.

4. Service Schedule

Equipment will be serviced according to the agreed schedule, which may include:

  • Waste pumping
  • Cleaning and sanitation
  • Restocking toilet paper and supplies

Service schedules may be adjusted due to weather, site conditions, or operational needs.

5. Service Access and Trip Charges

Customer must provide reasonable access for delivery, service, and pickup.

If the Company arrives but cannot complete service due to:

  • Locked gates
  • Blocked access
  • Animals on site
  • Unsafe conditions
  • Relocated equipment without notice

A service attempt or trip charge may be applied. Additional service attempts may result in additional fees.

6. Equipment Relocation

Equipment must not be moved or relocated by anyone other than Jettison Environmental LLC without prior approval.

Unauthorized movement may result in:

  • Service delays
  • Additional relocation or service fees
  • Customer assumes responsibility for damages or tipping incidents caused by relocation

7. Tip-Over and Weather Liability

Portable sanitation units may tip due to weather, wind, ground instability, or misuse.

Customer agrees that:

  • Jettison Environmental LLC is not responsible for damages, injuries, or contamination caused by tipped units after delivery
  • Customer is responsible for cleanup, site restoration, and additional service costs resulting from tipped units

Emergency cleaning or repositioning services may result in additional charges.

8. Wind Anchoring Responsibility

In areas where high winds or storms may occur, the Customer is responsible for ensuring units are properly positioned or secured if necessary.

Anchoring systems may be provided upon request and for an additional fee.

If units tip due to wind or storms and were not anchored or secured, the Customer assumes responsibility for all resulting damages, cleanup costs, and additional service fees.

9. Improper Use and Contaminated Waste

Units are designed for human waste only. Customer agrees not to place the following items in Equipment:

  • Trash or garbage
  • Chemicals or hazardous materials
  • Concrete, drywall mud, or construction debris
  • Paint or solvents
  • Any other foreign objects

If contamination occurs, Customer agrees to pay all additional pumping, cleaning, disposal, and environmental handling fees required to restore the unit.

10. Damage, Loss, or Theft

Customer is responsible for all Equipment during the rental period.

Charges may apply for:

  • Damaged units
  • Graffiti or vandalism
  • Excessive cleaning
  • Missing or stolen units

Replacement costs may range from $900 to $2,500 depending on the model and damage.

11. Billing Until Equipment Retrieval

Rental charges continue until all Equipment has been physically retrieved by Jettison Environmental LLC.

Delays caused by restricted access, unsafe conditions, or scheduling limitations may result in continued rental charges.

12. Payment Terms

Customer agrees to pay all rental and service charges according to invoice terms.

Failure to pay may result in:

  • Late payment fees
  • Suspension of service
  • Removal of equipment
  • Collection action

Customer agrees to pay all reasonable collection costs, including attorney fees.

13. Cancellation Policy

Orders canceled within 24 hours of scheduled delivery may be subject to a cancellation or mobilization fee.

14. Limitation of Liability

Jettison Environmental LLC shall not be liable for:

  • Indirect or consequential damages
  • Injuries resulting from misuse of equipment
  • Property damage from improper placement requested by the Customer

Customer assumes responsibility for safe use and supervision.

15. Indemnification

Customer agrees to defend, indemnify, and hold harmless Jettison Environmental LLC from any claims, damages, or liabilities arising from the Customer’s use, placement, or supervision of the Equipment.

16. Force Majeure / Weather Events

Jettison Environmental LLC shall not be liable for delays, damages, or service interruptions caused by events beyond its reasonable control, including storms, hurricanes, flooding, tornadoes, lightning, earthquakes, fire, or other acts of God.

Customer acknowledges that Equipment may be damaged or tipped during severe weather and assumes responsibility for securing or moving Equipment if instructed by the Company. Rental charges continue during any service disruption caused by such events.

17. Storm or Emergency Relocation

In the event of forecasted severe weather or emergencies, Jettison Environmental LLC may relocate, secure, or service Equipment at the Customer’s site.

Customer agrees to provide reasonable access and assumes responsibility for any additional charges associated with emergency repositioning or cleanup caused by storms, flooding, or wind damage.

18. Construction Site Shutdown / Restricted Access

If the Customer’s site becomes temporarily closed, inaccessible, or unsafe for service, rental charges will continue until Equipment is retrieved.

Additional service fees may apply for delayed or rescheduled visits.

19. Governing Law

These Terms shall be governed by the laws of the State of Alabama.

20. Agreement Acceptance

By signing, accepting delivery, requesting service, or submitting payment, the Customer acknowledges they have read and agree to these Terms and Conditions.

Acceptance of delivery, use of equipment, or payment of any invoice issued by Jettison Environmental LLC constitutes full acceptance, whether or not this document has been physically signed.
